Advocacy: NIGP Solicits Your Comments To Repeal The 3% Withholding Law |
This is your opportunity to be heard...comments are due March 1, 2009.
IRC Sec. 3402(t) - Withholding on Payments by Governments...
On December 5, 2008, the Internal Revenue Service issued proposed regulations implementing the 3 percent withholding law that is scheduled to take effect on January 1, 2011.
Section 511 of the Tax Increase Prevention and Reconciliation Act of 2005 required local government entities that spend more than $100 million annually on goods and services to withhold 3 percent of their payments to vendors and contractors.
Key points of the proposed rule:
• Impacts only payments over $10,000
• No flow down to subcontractors
• Withhold must be taken at time of sale for credit card payments
• Political subdivisions: 2 fiscal years earlier determines
$100 million threshold
• Passthrough entities (S Corps, Partnerships): withholds taken unless
80 percent owned by government entity
• Impacts only new contracts
• Credit can be taken against estimated income tax withholdings
• No credit against employment taxes (Medicare, Social Security)
• Government entities are liable for sending money to the U.S. Treasury
even if money not withheld from companies
• Somehow determined to not be a significant regulatory action
This rule will dramatically impact state and local governments. NIGP urges members to submit their comments and agency impact statements regarding the IRS proposed rule to advocacy@nigp.org by March 1. As an advocate for the procurement profession, NIGP will collect your comments and forward them to the IRS.
NIGP endorses legislation to repeal Section 511 of Public Law 109-222 (25 USC 3402(t).

NIGP Adopts Resolution to Purchase Green Commodities Through GSA Schedules |
Resolution Number: 1030
Purchase of Environmentally Preferable "Green" Commodities and
Services Through Access to U.S. Federal Government GSA Schedules
Whereas, the National Institute of Governmental Purchasing, Inc., supports forms of cooperative purchasing agreements between and among government agencies which have been shown to combine purchasing power and resources to obtain lower costs of procurement for quality goods and services, and
Whereas, the National Institute of Governmental Purchasing, Inc., recognizes the Federal General Services Administration’s program, extending federal supply schedules to state and local governments, as a cooperative purchasing opportunity providing state and local governments with procurement options, and
Whereas, the National Institute of Governmental Purchasing, Inc., wishes to adopt a policy encouraging agency members to favor the acquisition and use of environmentally preferable “Green” commodities and services and,
Whereas, opening additional GSA schedules to state and local governments would benefit many of the agency members of the National Institute of Governmental Purchasing, Inc., as a method for reducing costs of procuring environmentally preferable “Green” commodities and services.
Now, Therefore, BE IT RESOLVED, that the members of the National Institute of Governmental Purchasing, Inc., support procurement options, which reflect professional purchasing practices and are cost effective, and urge the United States Federal Government to expeditiously open the opportunity for state and local government agencies to access federal supply schedules containing environmentally preferable “Green” commodities and services.

Public Procurement Research Center: Call for Abstracts |
"Innovation in Public Procurement"
The Public Procurement Research Center and its Distinguished Faculty Fellows Program is in the process of producing a publication on innovation in public procurement supply chain management. The goal of the publication is to provide usable and practical examples of the different methods, tools and instruments that support public procurement innovation.
The PPRC hopes to include between five and ten cases exemplifying innovation in public procurement. To achieve this goal, your agency is invited to submit an abstract highlighting a success that you have had introducing a new idea, innovation, method, technology, application, or service to the field of public procurement.
Criteria to consider:
• Promotes innovative business practices, new product development,
skills and training of human capital, quality in services
• Enhances the delivery of effective government services, uses of quality
and environmental management systems
• Increases the effectiveness of supply chain management
and logistics/reverse logistics
• Creates new approaches to the provision of infrastructure
• Demonstrates tenacity, i.e. having been sustained against all difficulties;
was challenging, demanding or complex
• Improves the quality of the acquisition process
• Advances an innovative spirit among professionals
If your innovation does not fall within one of the categories above, you will not be excluded. This criteria is simply a guide. All potential innovations within the field of public procurement supply chain management are encouraged.
Please submit an abstract that highlights your case, paying particular attention to why this innovation is worthy of publication. Once the cases are selected, you will be contacted for follow-up discussion. Keep in mind, the principal audience for the abstract includes national and international government officials, CEOs, public procurement professionals, and researchers. Submissions must be received by Thursday, February 12, 2009.
To submit your abstract, please forward your submission to Dr. Clifford McCue at cmccue@fau.edu. Be sure to provide contact information so the PPRC can respond to each reply. Follow-up with selected agencies begins early in March.
The Public Procurement Research Center is a partnership between the National Institute of Governmental Purchasing, Inc. (NIGP) and Florida Atlantic University's (FAU) College of Architecture, Urban and Public Affairs. Through this partnership, inaugurated in 1999, NIGP recognizes FAU as the Institute's primary higher education associate in the area of research and educational programs.
