This Executive Leadership Series offers insight into issues that articulate the value of the profession to other stakeholders in your organization. Workshops will be conducted by professional facilitators and are intended to provide powerful, positive and useful information to support your efforts with internal and external clients.

Treasury Notice Soliciting Comments on 3% Withholding
This is your opportunity to be heard...
IRC Sec. 3402(t) - Withholding on Payments by Governments...
The Treasury and Internal Revenue Service is requesting comments on issues that should be addressed in guidance that the IRS will be developing regarding the Sec. 3402(4) to withhold on payments made by the government entities or their paying agents for services and property. The new withholding is required by Section 3402(t) of the Internal Revenue Code which was added by Section 511 of the Tax Increase Prevention and Reconciliation Act of 2005, Pub. L. No. 109-222 (TIPRA). Section 511 of TIPRA is effective for payments made after December 31, 2010.
The Treasury and the Internal Revenue Service are particularly interested in any comments regarding:
• How to apply the withholding requirements to purchases made with
credit cards or other forms of payment cards
• How to apply the withholding requirements if the payee is not subject to U.S. tax
• How to apply the withholding requirements to partnerships and other
pass-through entities in which a government entity is a partner or owner
• How to apply the withholding requirements to government contractors
and Subcontractors
• The application of the withholding requirements to so-called
Government—Sponsored Entities
• The application of the withholding requirements to de minimis payments for
property or services made by affected government entities
• When and how the withheld amounts should be transmitted to the IRS

Comments may also be transmitted electronically via the following e-mail address: Notice.Comments@irscounsel.treas.gov. Please include "Notice 2008-38" in the subject line of any electronic communications. Comments must be received by Monday, April 28.
NIGP supports repeal of the unfunded mandate in Section 511 of Public Law 109-222 (25 USC 342(t). NIGP endorses legislation to repeal this requirement, including H.R. 1023.

Member News: RMGPA Makes History
For the Rocky Mountain Govenmental Purchasing Association (RMGPA), March 12 was a historic day. It is the first time that Governor Bill Ritter, Jr. took time out of his busy schedule to welcome members of the Board of Directors and to sign an honorary proclamation declaring March as Government Purchasing Month.
The proclamation asserted that governmental purchasing organizations are to be commended for their diligent pursuit of efficiency in the operation of state and local government through their commitment to seeking goods and services of the highest value in terms of quality and process to maximize the benefit provided to the citizens.

UPPCC: Do You Have a Fully Certified Agency and Want To Be Recognized At Forum?
To be included in the award announcements at the 2008 NIGP Annual Forum in Charlotte, North Carolina, the UPPCC must recieve your 2008 Fully Certified Application by Monday, June 2.
Through its Fully Certified Agency Award program, the Universal Public Purchasing Certification Council (UPPCC) identifies organizations that have earned the distinguished and unique honor of achieving and/or maintaining a UPPCC fully certified public procurement staff. The UPPCC believes that having a fully certified procurement staff is a significant accomplishment and a strong indicator of current trends within state and local governments. This is an annual award and interested agencies must apply each year for consideration.
For an organization to be eligible to receive this award, every procurement professional employed by the agency must hold an active certification conferred by the UPPCC (CPPO or CPPB). Agencies having only one individual who is solely responsible for the procurement process are also eligible.
